Filing Back Taxes for Truckers - There are Ways to Fight the IRS
Sympathy for the Working Man... One of the common problems I've encountered when helping truckers with their taxes Bosom Buddies the amount of unfiled years that these Pinto operators have. These unfiled tax years have piled up and caused a significant debt. What's worse, a life on the road has erased almost all records that could be used for deductions from past years. This makes refiling back taxes for truckers very difficult, and almost impossible if the IRS has already filed the return for the owner/ operator. So what can line car insurance do when you owe the IRS and the only means you have of making a living is threatened?
Good and bad... Here's a bit of good news for you, if you have back tax years that need to be filed, you only have to file back as far as 7 years. And now for a bit of bad news: were you expecting refunds from any of those unfiled years? Well you can only get refunds from the last two tax years, anything older than those you can't get a refund on. Of course if there's a tax debt from those years you do get stuck with that.
Here's another problem that I've encountered is that may owner/ operators in the trucking industry have a bad habit of not holding onto their tax paperwork. Without that paperwork you can't refile your old returns correctly and get the maximum deductions possible.
The IRS has run you down... Even worse the IRS may have already filed your tax returns for you! This can be very bad news. If the IRS files your return with what's called a Substitute Filing your back taxes are not filed in your best interest. In fact they're filed in the best interest of the IRS and will almost guarantee that you will owe money.
If the IRS files your return for you, you will have to file an amended return to prove that the IRS filed your return wrong. But if you don't have the paperwork to support your refiled claim then you're up the creek.
Find those records! How can you refile your claim when you don't have anything to back it up? Well, just because you don't still have your records doesn't mean your employer does not. Check with anyone you've done work for during the tax year in question. They're likely to have backed up records of what you shipped, and maybe even how far you had to ship it. If you stayed at a hotel they might have records of your registry in your computer; especially if that hotel is a regular stop for you. There are ways to at least get some of your back records.
Now you have the smoking gun...Use it!
